REFUND POLICY

1. Introduction and Scope

This Refund Policy outlines the terms under which NU SEA Education, a registered education consultancy based in Kuala Lumpur, Malaysia, processes refunds for services rendered. This policy applies to all clients who engage NU SEA for consultation, application support, or advisory services related to higher education programmes, including Master's degrees, Bachelor's degrees, and Diploma programmes.

2. Nature of Services and Fee Structure

NU SEA Education operates as an intermediary education consultancy. We do not collect tuition fees on behalf of universities unless explicitly authorised in writing. Our fees typically cover consultancy services, application processing support, document review, and advisory sessions.

 

Any fees paid directly to universities, visa processing bodies (e.g., EMGS), or third-party service providers are governed by their respective refund policies, not NU SEA's. Clients are advised to review all fee agreements carefully before payment.

3. Refund Eligibility for NU SEA Consultancy Fees

Refunds for NU SEA's consultancy or service fees are considered on a case-by-case basis under the following scenarios:

Service Not Rendered: If NU SEA is unable to process the required documentation due to internal errors or oversight within our control, resulting in the service not being rendered, a full refund may be provided.

Client Withdrawal Before Service Commencement: If a client provides written notice of withdrawal via email to info@sea.com.my before any consultancy service has been rendered, a refund may be issued subject to a reasonable justification.

Client Withdrawal After Service Commencement: Once services have commenced (e.g., document review, university shortlisting, application submission), fees paid are generally non-refundable as professional time and resources have been allocated. Exceptions may be considered at NU SEA's sole discretion in cases of documented medical emergency or force majeure.

4. Non-Refundable Fees and Charges

The following fees and charges are explicitly non-refundable under any circumstance:

Administrative Processing Fees: Any admin fee charged for handling inquiries, documentation, or file setup.

Third-Party Fees: Fees paid to universities, EMGS, immigration authorities, testing centres (e.g., IELTS, TOEFL), or other external bodies. These are governed by the respective entity's policy.

 

Consultancy Fees After Service Commencement: As outlined in Section 3, fees for professional time and expertise rendered are non-refundable once work has begun.

 

Fees Related to Misrepresentation: If a client provides false, incomplete, or fraudulent information that leads to service termination or application rejection, all fees paid to NU SEA are forfeited.

5. Refund Procedure and Timeline

To request a refund, clients must submit a written request via email to info@sea.com.my, stating the reason for the request and providing supporting documentation where applicable. Verbal requests or messages via WhatsApp will not be processed for refund claims.

 

NU SEA will acknowledge receipt of the request within five (5) business days and review the claim based on this policy. If approved, refunds will be processed via bank transfer to the original payer's account within four (4) to six (6) weeks from the date of approval. Clients are responsible for providing accurate bank details; delays due to incorrect information are not the liability of NU SEA. Any outstanding debts owed to NU SEA will be deducted from the refund amount prior to disbursement.

6. Governing Law and Dispute Resolution

This Refund Policy is governed by and construed in accordance with the laws of Malaysia, including the Contracts Act 1950 and the Personal Data Protection Act 2010 (PDPA).

 

Any disputes arising from this policy shall first be addressed through good-faith negotiation between the client and NU SEA. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts in Kuala Lumpur, Malaysia.

7. Policy Updates and Client Notification

NU SEA reserves the right to update, amend, or revise this Refund Policy at any time to reflect changes in our services, operational practices, or Malaysian regulatory requirements. The "Last Updated" date at the top of this page will indicate when changes were made.

 

Clients are encouraged to review this policy periodically. Continued engagement with NU SEA after policy updates constitutes acceptance of the revised terms.
